2 Court Fees Required With Uncontested Divorce In California

Everyone has heard the words “uncontested divorce” and what you are saying is that you and your spouse are in agreement which is great.

But what uncontested divorce means to the Court is that the Petitioner filed a Petition and the Respondent filed a Response and in doing so you trigger both sets of court fees, one when the petition is filed and another court fee when the response is filed.

That is the court’s definition of an uncontested divorce in California.

But this is not necessary. If you are in agreement there is a better process called a default with written agreement. The default simply means a Response was not filed but overall it is the same process as an uncontested divorce, just with only having to pay the court fee once.
