HOW TO WIN CUSTODY OF YOUR CHILDREN AFTER A DIVORCE IN LAS VEGAS
Nevada law recognizes two forms of child custody in a divorce case: 1) Physical custody, and 2) legal custody.
Physical custody in Nevada involves the child’s physical living arrangements. If the child lives with one parent at least 60% of the time, that parent has primary custody.
If the child lives with each parent at least 40% of the time, the parents have shared or joint custody in Nevada.
Legal custody in Nevada, on the other hand, does not refer to living with the child. Instead, it involves the right to make important decisions about the child’s upbringing, such as major medical decisions, and where the child shall go to school.
During a divorce or legal separation, many parents agree to child custody agreements on their own. When they can’t, the Nevada court requires them to try mediation. If they still cannot agree, a judge will ultimately determine custody.
In Nevada, the judges sole consideration is the best interest of the child. Factors the judge will consider include:
-the child’s physical and emotional needs;
-the child’s ability to remain relationships with siblings;
-the child’s relationship with each parent; and
-the parents’ relationships with each other, as well as their medical and physical health.
If the child is old enough, the court will consider the child’s wishes.
The judge will also look to see whether there is any history of neglect or abuse in the family. If so, the judge may order investigation into whether physical custody is appropriate.
Remember, even if the judge does not award you physical custody, you may still be entitled to share legal custody in Nevada. Or, the court may grant visitation rights.
